Terms of Service

This User Agreement (hereinafter referred to as the 'Agreement') is a public offer in accordance with Art. 435 and Part 2 of Art. 437 of the Civil Code of the Russian Federation and governs relations between LLC 'Nauchnaya Studia' (hereinafter referred to as the 'Administration', 'Provider') and the user of the Focus24 service (hereinafter referred to as the 'User', 'Customer').

Acceptance of this offer is registration in the Service, payment for subscription, or beginning of Service use. Acceptance means full and unconditional acceptance by the User of the terms of this Agreement.
IMPORTANT: Focus24 is NOT a medical device, diagnostic or treatment tool. The Service provides informational data exclusively for self-observation and personal productivity improvement. Service data CANNOT be used for diagnosis or medical decision-making.
1. General Provisions
1.1. Service Description
Focus24 is an informational service for cognitive state monitoring that analyzes user's facial expressions using the device camera and provides data on alertness, focus, fatigue, and stress levels.
1.2. Age Restrictions
The Service is intended for persons who have reached 18 years of age. Use of the Service by persons under 18 is allowed only with parental or legal guardian consent.
2. Subject of Agreement, Prices and Payment Procedure
2.1. Subject of Agreement
The Provider undertakes to provide the Customer with access to the Focus24 online service for cognitive state monitoring, and the Customer undertakes to pay for services in the manner and under conditions provided by this Agreement.
2.2. Tariffs and Prices
Service cost:
- Focus24 Pro: 299 ₽/month — full access to all Service features
- Trial period: 7 days free for new users
Prices are indicated in Russian rubles and include all applicable taxes. The Provider has the right to change tariffs with at least 14 days notice to users.
2.3. Order Procedure
- User registers in the Service by providing email
- User selects a tariff plan on the subscription page
- User confirms agreement with the offer terms and privacy policy
- User makes payment by bank card
- After successful payment, access is provided instantly
2.4. Payment Procedure
- Payment methods: Visa, MasterCard, MIR bank cards
- Payment moment: deduction occurs at the moment of payment confirmation
- Confirmation: electronic receipt is sent to user's email
- Auto-renewal: subscription is automatically renewed if not cancelled before the end of the period
2.5. Service Provision Period
- Access to the Service is provided instantly after successful payment
- Subscription period is 30 calendar days from the moment of payment
- The service is considered rendered at the moment of providing access to Service functionality
2.6. Refunds
Refund conditions are set forth in the Refund Policy. Brief conditions:
- Within 14 days of payment — 100% refund without explanation
- After 14 days — refund proportional to unused period for technical issues
3. User Rights and Obligations
3.1. User has the right to:
- Use Service functionality in accordance with its purpose
- Access their data and statistics
- Delete their account and personal data
- Contact support service
3.2. User undertakes to:
- Comply with the terms of this Agreement
- Provide accurate information during registration
- Not use the Service for illegal purposes
- Not attempt to gain unauthorized access to the Service
- Not distribute malicious software
- Understand that Service data is for informational purposes only
4. Administration Rights and Obligations
4.1. Administration has the right to:
- Change Service functionality without prior notice
- Suspend Service operation for technical maintenance
- Block access for Users violating Agreement terms
- Change the terms of this Agreement with User notification
4.2. Administration undertakes to:
- Ensure Service operability within technical capabilities
- Protect User personal data in accordance with Russian legislation
- Consider User requests
5. Camera Use and Data Processing
5.1. Operating Principles
- The Service uses the User's device camera to analyze facial expressions
- Video stream is processed locally on the User's device and is not transmitted to servers
- Only aggregated numerical indicators are transmitted to servers
- User provides camera access voluntarily
5.2. Consent to Camera Use
By starting to use the scanning function, the User gives consent for the Service to access the device camera. The User can withdraw this consent in browser settings at any time.
Disclaimer: Accuracy of Service metrics depends on many factors, including camera quality, lighting, and individual characteristics. The Administration does not guarantee absolute accuracy of provided data.
6. Information and Its Protection
In accordance with Federal Law No. 149-FZ 'On Information, Information Technologies and Information Protection':
6.1. Right to Access Information
- User has the right to access information about the Service and conditions of its use
- User has the right to receive information about their personal data processed by the Service
- Information is provided free of charge in the manner established by law
6.2. Information Protection
Administration ensures information protection through:
- Application of technical protection measures (encryption, access control)
- Prevention of unauthorized access to information
- Timely detection of unauthorized access incidents
- Prevention of impact on technical means of information processing
- Ability to restore information in case of loss
- Monitoring of information protection level
6.3. User Obligations
User undertakes to:
- Not distribute information prohibited by Russian legislation
- Not perform actions aimed at disrupting Service operation
- Not carry out unauthorized access to information systems
- Respect copyright and related rights of third parties
6.4. Restriction of Access to Information
Administration has the right to restrict access to information in cases of:
- Protection of constitutional foundations, morality, health, rights and legitimate interests of others
- Ensuring national defense and state security
- Upon request of authorized government agencies
7. Intellectual Property
All Service materials, including design, software code, algorithms, trademarks and content, are the intellectual property of the Administration or its partners and are protected by copyright legislation (Part IV of the Civil Code of the Russian Federation).
8. Consumer Rights
In accordance with Russian Federation Law 'On Consumer Rights Protection' dated 07.02.1992 No. 2300-1:
8.1. Right to Information
Consumer has the right to receive complete and reliable information about the Service before concluding the contract, including:
- Basic consumer properties of the Service
- Price and subscription purchase conditions
- Payment and access provision procedure
- Operator information (name, address, details)
8.2. Right to Refuse Service
In accordance with Art. 32 of the Consumer Rights Protection Law:
- Consumer has the right to refuse contract performance at any time
- Upon refusal, consumer pays actually incurred Operator expenses

8.3. Right to Service Quality
Administration undertakes to provide Service of quality corresponding to its description and reasonable consumer expectations. Upon discovery of defects, consumer has the right to:
- Demand free elimination of defects
- Demand proportional price reduction
- Refuse contract performance and demand refund of paid amount
8.4. Right to Safety
The Service is safe to use when following recommendations and system requirements. Video data is processed locally on the user's device and is not transferred to third parties.
8.5. Right to Appeal
Consumer has the right to:
- File claims with the Administration
- Contact Rospotrebnadzor
- Apply to court at place of residence, defendant's location, or place of contract conclusion
- Demand compensation for moral harm in case of rights violation
9. Limitation of Liability
9.1. Administration is not liable for:
- Decisions made by User based on Service data
- Any damage related to use or inability to use the Service
- Actions of third parties
- Temporary Service unavailability
- Accuracy and completeness of provided data
9.2. Medical Disclaimer
The Service is not intended for:
- Diagnosing any diseases or conditions
- Replacing professional medical consultation
- Making treatment decisions
- Monitoring health status for medical purposes
If you have health problems, consult a qualified medical professional.
9.3. Preservation of Consumer Rights
Liability limitation provisions do not apply in cases where they contradict the Consumer Rights Protection Law. Consumer rights established by legislation cannot be limited by contract.
10. Dispute Resolution Procedure
Disputes are resolved in the following order:
- Claim procedure: send a written claim to support@focus24.pro. Review period — 10 business days
- Pre-trial settlement: if agreement cannot be reached through negotiations
- Judicial procedure: consumer has the right to apply to court at place of residence, defendant's location, or place of contract conclusion (Art. 17 of Consumer Rights Protection Law)
Consumers are exempt from state duty payment for consumer rights protection claims (clause 3, Art. 17 of Consumer Rights Protection Law).
11. Agreement Changes
Administration has the right to unilaterally change the terms of this Agreement. The new version comes into force from the moment of its posting on the website. Continued use of the Service after changing the terms means acceptance of the new version of the Agreement.
12. EU/EEA Users
If you are located in the European Union or European Economic Area:
- Processing of your personal data is carried out in accordance with the General Data Protection Regulation (GDPR)
- You have additional rights described in our Privacy Policy Section12 Privacy Link
- Disputes may be resolved through the EU Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr ec.europa.eu/consumers/odr
- You have the right to contact the data protection supervisory authority in your country
13. Final Provisions
- This Agreement is drawn up in accordance with Russian Federation legislation, including the Consumer Rights Protection Law and Federal Law 149 'On Information'
- For EU/EEA users, GDPR provisions also apply
- If any provision of the Agreement is found invalid, other provisions remain in force
- Conditions that infringe consumer rights compared to legislation are considered invalid (Art. 16 of Consumer Rights Protection Law)
- The Agreement is a public offer in accordance with Art. 435 and Part 2 of Art. 437 of the Civil Code of the Russian Federation
